OPINION: UZODINMA vs IHEDIOHA...... SENATOR ALIMIKHENA'S AIDE CAUTIONS AGAINST CONSTITUTIONAL CRISIS.
Following comments by concerned nigerians on the Supreme Court judgment on the Imo Governorship election of March 19 which culminated in the sack Emeka Ihedioha as Governor of the state, a political scientist has urged all parties to allow the verdict stay, since it is irreversible.
According to Mr. Benjamin Atu, a political who is also the Special Assistant to Senator Francis Alimikhena on Media and Publicity, he expressed concerns over the decision of the People's Democratic Party to continue to pressurise the Supreme Court to reverse itself on the Imo State governorship verdict that nullified the election of Emeka Ihedioha and ordered the swearing-in of Senator Hope Uzodinma as the duly elected governor.
The Special Assistant to Senator Francis Alimikhena on Media and Publicity, has therefore, appealed to the PDP to accept the Supreme Court Judgement as the final verdict which cannot be reviewed or reversed.
"The Supreme Court cannit overrule itself and depart from its own decision. It cannot sit on an appeal on the matter it has already decided as an appellate court on its own decision. The Nigeria Constitution empowers the Supreme Court, as the last Bus stop of every legal battle and the PDP cannot subject the law of the land to actualise their wish", he stated.
"The demand of the PDP to review the verdict of the apex Court should start from reviewing the apex law of the land. The Nigeria constitution must first be reversed for the Supreme Court to grant the prayers of the PDP", he said.
"PDP should desist from creating Constitutional crisis in Nigeria in their desire to show solidarity in order not to plunge the country into violence in their bid to mourn their lost sheep. The proposed plan to storm the Supreme Court by the PDP is to cause constitutional crisis and deepen our already polarised political system".
"Nigerians should rise against this illegality by the PDP", Atu stated.
According to Benjamin Atu, the Supreme Court has the power to temper with the Judgment of the Tribunal and Appeal Court particularly when such Judgement by those Court are perverse. The extent to which the judgment was perverse and the evidence of such perversity should be left to God and not subjected to review or reversal because, in God's judgment, there is no appeal.
"The Supreme Court judgment is God's judgment; it cannot be undone with or without pressure and protest from the PDP", he said.
"The People's Democratic Party is seeking the opportunity to rubbish the supremacy of the Supreme Court in order to set bad precedence in our democracy", he further disclosed.
The political scientist cum media guru maintained that the PDP may have suffered a great loss from the outcome of the supreme court judgment, but what must not be lost is their spirit and resiliency as a party because, we need such resistance to remain a democratic nation.
"PDP is at liberty to organise solidarity protest to mourn their loss but, the call to reverse the apex court decision is a joke taken too far", he warned.
"There is already a report of disagreement within the PDP both in Imo and at the National level. If the claim by the PDP against the Supreme Court was correct, the PDP's protest would have been lead by their Presidential candidate, Alhaji Atiku Abubakar. How come that the same Local Government in Imo State, Mbaise, where Atiku got the lowest vote is the same Local Government Ihedioha scored his highest vote? How can PDP lay claim to the victory of Imo State election when President Buhari got about 140,000 vote to defeat Atiku in the same Imo State? The PDP should rather be appreciative that the Supreme Court did not look into this suspicious figures from Mbaise and other areas or else, they won't be seeking a reversal of the judgment.
While appealing to the National Chairman of the PDP to tread cautiously, Atu advised the People's Democratic Party leadership to patiently, study the history of elections in Imo State since 2003 during the era of Achike Udenwa. Imo PDP has a dangerous history of abandoning their own candidate during general election to support others.
"That could be the reason Senator Hope Uzodinma did not seek his Governorship ticket under the PDP platform. In 2007, PDP in Imo State abandoned their own Ararume to support Ohakim. In 2011, PDP in Imo also dumped their own candidate Ohakim to support Rochas Okorocha. Now, in 2019 the same PDP not only betrayed Atiku Abubakar by voting Buhari, they also gave their vote to Hope Uzodinma against their own Emeka Ihedioha".
"I am calling on the PDP National leadership to review the Imo State political history and correct the abnormality rather than trying to embarrass the apex Court of the Federal Republic of Nigeria. The PDP should go ahead and celebrate their Supreme Court victory in Sokoto, Benue and many other States rather than creating constitutional crisis to justify unrealistic conclusions", Benjamin Atu stated.
